Terms of Service
Last updated 25 September 2026
How we work together, in plain English: what you pay and when, how to leave, and who owns what.
The short version
- Prices are published, in AUD and exclude GST. Monthly services are billed in advance.
- No lock-in: monthly services are month to month, and 30 days notice by email is all it takes to cancel.
- Websites: a 30% deposit to start, a private preview to review, and the balance at launch.
- Once work is paid for, you own it. Your domain, logins and data are always yours.
- Our services come with guarantees under the Australian Consumer Law that nothing here takes away.
This summary helps you find your way. The full text below is what applies.
01About these terms
These terms are an agreement between you and Omniwink (ABN 69 794 946 307) ("Omniwink", "we", "us"). They apply when you use our website and free tools, and when you buy any of our services.
If we agree anything different with you in writing, such as a proposal or quote, that written agreement applies where it differs from these terms.
If you are using our services for a business, you confirm you are authorised to agree to these terms on its behalf.
02Free tools
The visibility scan and website blueprint are free and come with no obligation.
Scan scores are based on what is publicly visible on a website at the time of the scan. Reports, blueprints and sample posts are drafted with AI and are general guidance only, not professional advice. You are welcome to use the sample posts we give you.
Only submit a website you own or are authorised to have reviewed.
03Prices and billing
Our prices are published on our website. All prices are in Australian dollars and exclude GST, which is added to invoices where it applies.
Monthly services are billed monthly in advance. Invoices are due within 7 days unless we agree otherwise.
If a payment is overdue, we will remind you first. If it is still unpaid after 14 days, we may pause work until it is paid.
We may change our prices from time to time. For existing clients, a price change takes effect only after 30 days written notice, and you can cancel before it applies.
04Monthly services
Our monthly services (the Content Engine, Growth Systems, hosting and care, ongoing SEO, automation care and AI receptionist running fees) run month to month. There is no minimum term and no lock-in contract.
Either of us can cancel with 30 days written notice. An email is enough. Services continue, and are billed, until the end of the notice period.
Growth Systems has a one-off setup fee of $490, which is waived when you also have a Content Engine plan.
What each plan includes is described on our website at the time you sign up.
05Website builds
Every website build has a fixed price, agreed before we start from your blueprint or quote.
- A deposit of 30% of the price secures your build slot and comes off the total.
- We build your site on a private preview link. Each build tier includes the rounds of changes described on our website. Changes beyond those, or new work outside the agreed scope, are quoted separately before we do them.
- The balance is due at launch, before we move the site to your domain. Studio and Signature builds can instead be paid in 5 monthly payments.
- Once the site is paid in full, we move it to your domain, set up hosting, and hand over every login.
The deposit covers the planning and design work we start straight away, so it is not refundable once work has begun. If you end a build partway through, you pay for the work completed to that point, and the deposit counts towards it.
Domain names, email and other third-party subscriptions belong to you and are billed by those providers. Hosting and care is optional, at $59/mo.
06AI Automations
Custom automations have a fixed quote before we build. We tell you before we start if something cannot connect to the tools you use.
Automations run in your own accounts. Subscriptions to the third-party tools they connect to are yours to pay.
Automation care ($149/mo) covers monitoring, fixes and small changes. Without it, fixes and changes after handover are quoted separately.
Our AI receptionist tells callers it is an AI assistant. It never pretends to be a person.
07Content and approvals
We write content from the brand file we create with you, and a person checks it before it goes out. You can ask to approve everything before it is published.
You are responsible for the accuracy of the information you give us, such as your prices, services, qualifications, licences and offers, and for the claims your business makes.
If your industry has advertising rules, you are responsible for making sure published content meets them. For example, registered health practitioners such as dentists and physiotherapists must follow AHPRA's advertising guidelines, including the rules on testimonials. Tell us about any rules that apply and we will write to them.
Tell us straight away if anything published needs to change and we will fix it.
08Your responsibilities
- Give us the access, information and feedback we need, in reasonable time. Delays on your side can move timelines.
- Only give us material you have the right to use, such as photos, logos and testimonials.
- Make sure you have your customers' consent before we message them on your behalf, as required by the Spam Act 2003 and the Do Not Call Register Act 2006.
- Do not use our services for anything unlawful, misleading or harmful.
09Who owns what
You own what we make for you once it is paid for: your website, content, brand file, automations and data. Your domain, logins and accounts are always yours, and if we part ways you take everything with you.
We keep ownership of our own tools, templates, processes and know-how, and you can keep using anything we built with them for you.
The Omniwink Hub is provided on a subscription while you use Growth Systems. If you leave, we will help you export your data.
We will only show your business in our portfolio or marketing with your permission.
10Third-party platforms
Our services rely on platforms we do not control, such as Meta, Instagram, Google, LinkedIn, GoHighLevel and AI providers. They can change their features, rules, pricing or reach, or have outages. We will work around changes where we can, but we are not responsible for what those platforms do.
11Results
We do the work to make your business more visible and easier to book, and we report on calls, bookings and reviews. Because results also depend on your market, competitors and platforms outside our control, we cannot guarantee specific rankings, reach, leads or revenue.
12Your rights under Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms limits those rights.
To the extent the law allows, our total liability to you for any claim relating to our services is limited to the fees you paid us for the affected service in the 3 months before the claim, and we are not liable for indirect or consequential loss, such as lost profits.
13Ending our work together
You can end any monthly service with 30 days notice, as above. We can end our services with 30 days notice, or straight away if an invoice is more than 30 days overdue or these terms are seriously breached.
When our work ends, you pay for the services provided up to the end date, and we hand over everything that is yours.
14Privacy
How we handle personal information is explained in our Privacy Policy, which forms part of these terms.
15Changes to these terms
We may update these terms. For existing clients, changes take effect 30 days after we let you know. If you do not agree to a change, you can cancel before it applies.
16Governing law
These terms are governed by the laws of Victoria, Australia, and you agree to the courts of Victoria.
